Incident Reporting

We encourage our insureds to report any medical incident or occurrence they believe could result in a claim. Examples of such situations include:

  • Patient or family expressing dissatisfaction with care¬†
  • Dispute over billing
  • Verbal threat to take legal action
  • Unexpected adverse complication or outcome
  • Request for the patient's medical record

In summary, report any incident involving medical care about which you are uncomfortable or which you suspect may result in a future claim.

Claims Reporting

All claims need to be reported to The Mutual.  A claim includes the following:

  • Notice of Intent (90 Day Notice) from an attorney or the patient
  • Demand for money in writing from an attorney or patient
  • Complaint from the patient or family in writing

All claims must be reported to The Mutual in writing. Failure to report a claim as soon as you are aware of it may jeopardize your coverage. Although we encourage you to telephone The Mutual Claims Department to discuss a claim and the sequence of events that occurred, The Mutual does not consider the claim to have been made for purposes of securing coverage under your policy until written notice is received via regular mail or email with the following information:

  • Date, time and place of your treatment
  • Facts and circumstances of your treatment
  • Patient or claimant's name, address and age

Summons and Complaint (Lawsuit)

If you have been served with a Summons & Complaint, either by mail or by process server, please contact The Mutual immediately with information concerning the lawsuit. This includes Small Claims Court suits. If you receive the Summons in the mail, do not sign the back of the form as requested. Contact The Mutual for advice. If you are uncertain what to report or the nature of legal documents you may have received, contact The Mutual at (800) 760-8228.

Disciplinary Actions

The Mutual provides defense reimbursements for disciplinary actions and administrative investigations. Once you receive notice please contact The Mutual immediately. Disciplinary actions include, but are not limited to, the following:

  • State Medical Board
  • Regulatory
  • HIPAA
  • Peer review

Depositions

If you receive a notice to appear at a deposition, please contact The Mutual to discuss and report the deposition request or subpoena. The Mutual will provide an attorney to assist and appear at the deposition if the request involves an underlying medical professional liability matter.
